In order to make the people in the city more happy, peaceful, happy and healthy during the Spring Festival, and to ensure public safety and the personal and property safety of the people, according to the People’s Republic of China (PRC) Air Pollution Prevention Law, the People’s Republic of China (PRC) Public Security Management Punishment Law and the Regulations on the Safety Management of Fireworks and Firecrackers and other laws and regulations, we hereby further improve the work related to the safety management of fireworks and firecrackers during the Spring Festival of 2024 in Shangqiu as follows:
First, the discharge time
(1) February 2 (23rd of the twelfth lunar month) from 7: 00 to 23: 00;
(2) From 7: 00 on February 9th (New Year’s Eve) to 1: 00 on February 10th (the first day of the first month);
(three) from February 10th (the first day of the first month) to February 14th (the fifth day of the first month) from 7: 00 to 23: 00 every day;
(four) February 24th (the fifteenth day of the first month) from 7 am to 23 am;
Fireworks and firecrackers are prohibited during heavy polluted weather and outside the above provisions.
Second, the forbidden area
Fireworks and firecrackers can be set off outside the following places:
(a) the residence of state organs;
(2) Chemical parks and units that produce, manage and store inflammable and explosive materials;
(3) Important military facilities;
(4) cultural relics protection units;
(five) schools, kindergartens, hospitals, nursing homes, nursing homes, etc.;
(six) shopping malls, commercial streets, bazaars, public cultural facilities, places for religious activities and other crowded places;
(seven) bus stations, railway stations, high-speed railway station, railway safety protection zones, primary and secondary roads, elevated roads, overpasses, bridges, tunnels and other transportation hub areas;
(eight) power transmission and transformation, gas, fuel and other energy facilities in the safety protection zone;
(9) Within 60 meters of high-rise buildings, buildings with low fire resistance rating and projects under construction that use flammable and combustible external thermal insulation materials;
(ten) parks (except squares), green spaces, scenic spots, woodlands, nurseries, wetlands, water source protection areas and other key fire prevention areas;
(eleven) the people’s governments of counties (cities, districts) and the administrative committee of the urban-rural integration demonstration zone determine and announce other places and areas where discharge is prohibited.
The place where fireworks and firecrackers are prohibited and the specific scope around it shall be set up by the relevant units with obvious warning signs prohibiting fireworks and firecrackers.
Advocate the masses to set off fireworks and firecrackers in a civilized way, and do not set off fireworks and firecrackers in residential areas for the safety of themselves and others.
Three, the ban on the sale of fireworks and firecrackers.
(1) Grade A and B products in Safety and Quality of Fireworks and Firecrackers (GB10631-2013) and Grade C and D products that need to be processed and installed;
(2) Fireworks and firecrackers that are dangerous and contain highly sensitive drugs, such as pulling guns, throwing guns and smashing guns;
(3) Fireworks and firecrackers, such as rotating and double-sounding guns, which are launched by the main body during discharge;
(four) illegal production and operation of fake and shoddy fireworks;
(5) Other fireworks and firecrackers whose sale and discharge are prohibited.
Four, fireworks should comply with the provisions.
Fireworks and firecrackers shall be discharged correctly and safely according to the discharge instructions, and the following provisions shall be observed:
(a) shall not be set off in the corridors, balconies, windowsills and roofs of residential buildings;
(two) not to pedestrians, vehicles, buildings, structures and crowded places;
(3) Do not aim at or point to the discharge of inflammable and explosive articles;
(four) there shall be no acts that affect public order and endanger the personal and property safety of others;
(five) minors should set off fireworks and firecrackers under the guidance of their guardians or other adults;
(six) it is forbidden to carry fireworks and other dangerous goods by public transport such as passenger buses, buses and taxis;
(seven) it is strictly prohibited to set off fireworks and firecrackers in non-discharge time and non-discharge areas;
(eight) fireworks should be purchased from a legitimate fireworks retail store (point) that holds a "fireworks business (retail) license".
Five, the sales of fireworks and firecrackers shall comply with the provisions of.
(a) the time allowed to sell fireworks and firecrackers is from January 31st (the 21st day of the twelfth lunar month) to February 24th (the 15th day of the first month); Fireworks and firecrackers that have not been sold in the above time should be disposed of safely and cleared of inventory.
(two) it is strictly forbidden to store fireworks and firecrackers in family houses and residential buildings for the purpose of sales.
(three) without obtaining the business license of fireworks, no unit or individual may engage in fireworks business activities.
(four) it is strictly prohibited to sell fireworks beyond the scope of permission.
Six, the punishment of illegal acts
The illegal production, transportation, storage, sale and illegal discharge of fireworks and firecrackers shall be punished in accordance with the Law of People’s Republic of China (PRC) on Public Security Administration Punishment and the Regulations on the Safety Management of Fireworks and Firecrackers, and criminal responsibility shall be investigated according to law if the case constitutes a crime.
